Article 48: Foreigners married to Taiwan nationals and who have residency rights based on the marriage have free work rights in the Taiwan area. They do not have to apply for a work permit as of mid-May 2003. (Note: This means that the foreigner must have an ARC. The Taiwan spouse must have Household Registration in the Taiwan area.)

雇主聘僱外國人工作,應檢具有關文件,向中央主管機關申請許可。但各 級政府及其所屬學術研究機構聘請擔任顧問、研究工作者或與在中華民國 境內設有戶籍之國民結婚,且獲准居留者,不須申請許可。 前項申請許可、廢止許可及其他有關聘僱管理之辦法,由中央主管機關會 商中央目的事業主管機關定之。 第一項受聘僱外國人入境前後之健康檢查管理辦法,由中央衛生主管機關 會商中央主管機關定之。 前項受聘僱外國人入境後之健康檢查,由中央衛生主管機關指定醫院辦理 之;其受指定之資格條件、指定、廢止指定及其他管理事項之辦法,由中 央衛生主管機關定之。 受聘僱之外國人健康檢查不合格經限令出國者,雇主應即督促其出國。 中央主管機關對從事第四十六條第一項第八款至第十一款規定工作之外國 人,得規定其國別及數額。 |
Article 51: The following four types of persons have liberalized work rights in the Taiwan area, but must still file for a work permit.

Note 1: Can a Category 51.01.01, 51.01.03, or 51.01.04 person apply for an Employer-based Work Permit? The answer is yes, but since a Personal Work Permit allows you to work anywhere, that is the better option.Note 2: Can an ordinary foreigner who has a work permit via his employer through the standard Employment Services Act Article 46 method have another company/organization apply additionally for an ESA 51.01.02 work permit? The answer is that if he/she qualifies for 51.01.02, then there is no known rule against it.
Note 3: Can a foreigner have multiple ESA 51.01.02 Employer-based Work Permits, via different companies/organizations, to effectively be able to work legally at multiple locations? The answer is yes.

雇主聘僱下列外國人從事工作,得不受第四十六條第一項、第三項、第四
十七條、第五十二條、第五十三條第三項、第四項、第五十七條第五款、
第七十二條第四款及第七十四條規定之限制,並免依第五十五條規定繳納
就業安定費:
一 獲准居留之難民。
二 獲准在中華民國境內連續受聘僱從事工作,連續居留滿五年,品行端
正,且有住所者。
三 經獲准與其在中華民國境內設有戶籍之直系血親共同生活者。
四 經取得永久居留者。
前項第一款、第三款及第四款之外國人得不經雇主申請,逕向中央主管機
關申請許可。
外國法人為履行承攬、買賣、技術合作等契約之需要,須指派外國人在中
華民國境內從事第四十六條第一項第一款或第二款契約範圍內之工作,於
中華民國境內未設立分公司或代表人辦事處者,應由訂約之事業機構或授
權之代理人,依第四十八條第二項及第三項所發布之命令規定申請許可。

Instructions: Include the necessary attachments, and mail the application in to the address indicated by registered mail. Manpower Agent may be left blank. Don't indicate that you will pick up the form in person. The CLA will mail it back to you by registered mail.
We had a meeting at the Presidential Office on 2003.07.24 to discuss foreigner's rights in Taiwan. The CLA representative said that a Personal Work Permit entitles the holder to do any work that doesn't require a separate license.
I don't have any more information on these application procedures or eligibility procedures than is provided here. So if you have further questions, I recommend you write a Chinese-language letter to the Council of Labor Affairs in Taipei for clarification. The address is on the application forms. I would appreciate receiving a copy of your inquiry letter and any reply received, so that I can keep it on file. Please mail photocopies to my address in Taipei, which I can give you if you send me an email.
